City Extends Ban on Pot Clubs

The extension of a moratorium issued last year will prohibit medicinal marijuana dispensaries from opening in Union City for another year.

The City of Union City has extended a temporary ban prohibiting medicinal marijuana dispensaries from opening within city boundaries.

City Council approved the extension 5-0 last Tuesday.

The temporary moratorium was initially adopted last year on Jan. 24, 2012 following the opening of CHA Wellness Center, a dispensary that was located at 34695 Alvarado-Niles Rd. According to city staff, the dispensary never had legal permission to operate in Union City.

The moratorium banned the approval of business licenses or permits for medical marijuana dispensaries, along with the sale and distribution of medicinal marijuana, for a period of 45 days. An extension was issued on Feb. 28, 2012 for an additional 10 months and 15 days.

The new extension is the last that can be issued on the moratorium, according to a staff report.

It is set to expire Jan. 24, 2014.

According to a staff report, the moratorium was extended to “protect the public health, safety and welfare and provide staff additional time to study how to best address the potential imminent threats to public safety, health, and welfare resulting from medical marijuana dispensaries.”

Local regulation of dispensaries and pot clubs has been the subject of recent California Supreme Court cases, several of which are currently under review.

“In light of the Supreme Court's granting of review of these cases, any cases that the City previously relied upon regarding medical marijuana establishments are no longer cited as controlling law, and it is uncertain what potential impacts the Supreme Court's decision will have on the ever changing developments in medical marijuana regulation,” City Attorney Benjamin Reyes wrote in a Jan. 8 staff report.

**My guess is drug companies don't want to hear this** My wife has a serious case of Crohn's Disease (auto-immune GI disorder) that ravages her intestines causing her to loose weight (she's currently sub 80lbs) and experience intense debilitating pain. Her pot vaporizer helps with: - Nasia allowing her to eat and not throw up (better than the prescription Zofran) - Some pain relief - Seems to relax the intestines - Allows her to get more sleep It's literally a miracle plant for her. I hope some day it will be more widely accepted.

Excellent point George. Regulate it like alcohol, with the same restrictions: 21 and over, not allowed to drive, or operate machinery while under the influence. This would at the same time take the burden off our penal system, and let us put the real criminals in jail/prison. The people that don't like these Marijuana initiatives are the same folks that have no issue with guns/assault rifles, hard to find logic in their views.

Doctors were starting to get me hooked on vicodine and anti-inflamation pills for my back spasms/flare ups after I dislocated my discs in my spine at work when i was 19... The theraputic nerve creams made from cannabis plants is a miracle. No more stupid pills for me. All those pills do is destroy your insides and liver/kidneys overtime.

It is to bad that you could get arrested if you tryed to loby congess about canibus and other natural drugs. I wonder why they use morphine, a derivitive of Opeum still? Must be, they can sell it for a lot of money to hospitals. They call it a "Gateway Drug" to stronger Drugs but the fact is, Medical useage is usually the last stage of life usage not Teen Age stupidness. They call it Dope, yet the dopes are in Washington who forbid the medical usage..
